What a foreigner can actually own in Business Bay

The rule is the same across Phuket, and it is the first thing to get straight before you look at anything in Business Bay. A foreigner can own a condominium outright, freehold, with the title deed in their own name — not a lease, not a company, not a nominee arrangement.

Land is different. Foreigners cannot own it, which is why villas here involve long leases or company structures that need proper legal advice. Each building may sell up to 49% of its floor area freehold to non-Thais; past that, units go leasehold. So the freehold stock in any given Business Bay building is finite, and worth checking which you are being offered before anything else.

What it costs beyond the price

The asking price in Business Bay is not the number to budget against. On completion you will meet a transfer fee, and depending on how long the seller has held the property, either specific business tax or stamp duty, plus withholding tax. These are usually split between buyer and seller by negotiation, so who pays what is worth settling in writing early.

Then there are the running costs that decide whether the numbers work: a service charge billed per square metre each year, a one-off sinking fund contribution for major works, utilities, and insurance. On a hotel-managed home the operator also takes a share of rental income.
